Action on Grounds of Unmerited Gain
Article 534
- (1)
- Where the bearer of a bill of exchange, a promissory note or a cheque forfeits the right to an action under them due to expiration by limitation or non-performance of the necessary acts for retaining the rights thereunder, he may claim from the drawer or the drawee the sum which they have gained to his detriment.
- (2)
- The action under paragraph 1 shall expire by limitation after three years. This term shall commence from the date of forfeiture of the actions under the bill of exchange, the promissory note or the cheque.
