§ 23. Definition and classification of fruit
- (1)
- Fruit is any kind of benefit receivable from use of a thing. Fruit is natural fruit or civil fruit.
- (2)
- Natural fruit is the product of a thing arising by the forces of nature or with human assistance. Until severance, fruit is an essential part of a thing.
- (3)
- Civil fruit is income receivable from a thing due to legal relations.
§ 24. Ownership of fruit
- (1)
- Fruit belongs to the owner of a thing unless otherwise provided by law or a transaction.
- (2)
- If a person has the right to receive the fruit of a thing during a certain time, and unless otherwise provided by law or a transaction, the natural fruit severed from the thing during that time or the part of the civil fruit corresponding to that time belongs to the person.
§ 25. Reimbursement of expenses upon demand of delivery of fruit
A person who is required to deliver fruit has the right to demand reimbursement of expenses made for obtainment of the fruit to the extent which is necessary for regular management of the thing and does not exceed the value of the fruit.
