Commission Report 2002 (Romania)
Romania has made good progress in implementing reform of the child care
system in accordance with the National Strategy on the Protection of Children
in Need. Budget provisions for children in care have been increased, and
initiatives have been taken to address the particular problems of children
with chronic diseases and handicaps oe although additional efforts are needed
to develop an inclusive educational policy for disabled children. In the
absence of such a policy, the closure of special schools has been hampered.
Measures have also been taken to support the integration of young people
leaving residential care institutions into society. New legislation on
international adoption has been prepared and based upon the provisions of the
Action Plan, and efforts have been made to develop the administrative
capacity that would be required to implement this legislation. While this
process has been carried out the moratorium on international adoption has
remained in place. In line with the Action Plan, steps have been taken to
develop administrative capacity in order to implement the Government Strategy
on the improvement of the situation of Roma. The local structures for
implementation of the Strategy have been established and measures have been
taken to re-enforce the capacity of the national office for Roma. This said,
the levels of financial support provided for the Strategy`s implementation
have been inadequate and in this respect the Action Plan has not been fully
implemented. Romania has adopted a National Strategy on the Improvement of
the Situation of Persons with Handicaps. Effective implementation of the
strategy will depend upon sufficient budgetary support and developing
administrative capacity, both at national and local levels - a process that
is on-going in line with the measures foreseen in the Action Plan. In
accordance with the Action Plan, Romania has established the institutional
framework in order to implement legislation on the prevention and combating
of all forms of discrimination. However, the institution concerned (the
National Council for Fighting Against Discrimination) is not fully compatible
with the acquis.
The Accession Partnership priorities related to the political criteria
have been partially met. For those priorities also covered by the Action Plan
the actions foreseen in the Action Plan are largely on track.
