Commission Report 2002 (Romania)
The legislation on the Romanian State Border and on the Organisation and
Functioning of the Border Police was adopted. The use of conscripts as border
police is being rapidly phased out and the establishment of an
Inter-ministerial Group for Integrated Border Management represents a first
step towards developing an integrated border management strategy. The
establishment of a National anti-corruption Prosecution Office could help
improve the co-ordination between law enforcement bodies from prevention to
prosecution as foreseen by the Action Plan. However, the Office is not yet
fully operational and Romania cannot be said to be implementing an integrated
strategy for the fight against corruption. Due to delays in adopting the
appropriate legal framework, Romania`s participation in EUROPOL is still
pending. No progress has been made with developing and implementing a
national drugs strategy. Romania has recently started to establish a national
focal point for contacts with the European Monitoring Centre on Drugs and
Drug addiction. Romania ratified the Council of Europe Convention on
Laundering, Search, Seizure and Confiscation of the Proceeds from Crime in
August 2002. The measures contained in the Action Plan to strengthen the
administrative capacity of the National Office for Preventing and Fighting
Money Laundering Operations are in the process of being implemented. As
foreseen in the Action Plan Romania presented a Schengen Action Plan in
December 2001. This should be further elaborated in order to cover all areas
included in the Schengen Convention. It will be monitored and updated on a
yearly basis. Romania has also made progress with alignment of visa
legislation and practice but does not yet fully comply with the acquis.
Romania has taken a wide range of measures in order to ensure the
implementation of Community instruments in the area of judicial co-operation
in civil matters. However, Romania still needs to align its legislation with
the Convention on the Protection of the Communities' Financial Interests
and its Protocols. Overall, the Accession Partnership priorities have been
partially met. The implementation of the measures under the Action Plan has
started.
