Act on Lotteries and Other Similar Games

(Act No. 218/2001 Coll. amending the Act of the National Council of the Slovak Republic No. 194/1990 Coll. on Lotteries and Other Similar Games, as amended)

The amendment of the Act on lotteries omits the provision, pursuant to which a term 'consumer lottery' included also competitions, inquiries and other prize- shows, where an operator or a provider of goods, service or another supply under the conditions stipulated in the act undertook to provide the participants with non-cash prizes, e.g. services or goods.

The amendment further contains respective legislative and technical specifications in connection with the omission of the above stated provision.

The change in the legal regulation of operation of lotteries and other similar games enables subjects, other than a state budgetary organisation or a state contributory organisation established by a ministry, or a legal entity with its registered seat in the Slovak Republic with a 100% state participation established by a ministry, to operate consumer lotteries (which are understood as competitions, inquiries and other shows for prizes, where an operator or a provider undertakes to provide the participants determined by draw or another random choice with cash prizes, and where the pre-condition of participation is purchase of certain goods, service or another supply and declaration of this purchase to the operator, or conclusion of a contract with the provider, or the participation in a promotional or advertising show of the operator or provider, either directly or indirectly through another person), even in case of their full or partial realisation through internet or mass media (television, radio, newspapers, etc.).

This amendment is in force from 1 July 2001.
