Amendment to the Act on Land Book Register(Act of the National Council of the Slovak Republic No. 255/2001 Coll. amending and supplementing the Act of the National Council of the Slovak Republic No. 162/1995 Coll. on Land Book Register and Entry of Ownership Titles and Other Rights Relating to Real Estate (the Act on Land Book Register), as amended.) According to the amended provision of Section 11, previous competencies and powers of district offices and regional offices within the scope of local land book registers are transferred to land book register offices (the ``Office'') and land book registers administrations (the ``Administration''). The amendment also changes and supplements Section 16, in which activities and seats of Offices and Administrations are defined. The important change, comparing to the previous regulation, is that Section 28 is supplemented by a new paragraph 5 according to which effects of registration of ownership title arising from an agreement on transfer of a flat and from an agreement on transfer of non-residential premises originate as of the day of delivery of an application for registration of ownership title of the Office. According to the current legal regulation, effects of registration of ownership title from the agreement on transfer of a flat and from the agreement on transfer of non-residential premises originate in the same manner as effects of registration of all other transfers (i.e. after the registration of ownership title into the land book register is allowed by the Office). The Amendment also partially changes Section 30 and newly defines the term ``party to legal proceedings''. According to the new regulation, ``the party to legal proceedings'' is a party of the legal act on the basis of which the title to real estate creates, alters or ceases. According to this provision, the legal proceedings on approval of registration start upon an application of the party to legal proceedings, and not as it is until the effectiveness of the amendment, upon an application of the owner or another authorised person. The Amendment also stipulates documents which should be attached to the application for registration of ownership title into the land book register. The Amendment comes in force from 1 January 2002. |
