Act on Ombudsman

Act No. 564/2001 Coll. on the Public Defender of Rights

This Act regulates (a) a scope and manner in which an ombudsman (public defender of rights) as an independent body participates in protection of fundamental rights and freedoms of individuals and legal entities at proceedings, decision-making or inactivity of public administration authorities if their proceedings, decision-making or inactivity is in conflict with the law or principles of a democratic and legal state, and (b) details on election and recall of the ombudsman, his/her operation, conditions of performance of his/her office, manner of legal protection and on application of rights of individuals and legal entities.

The National Council of the Slovak Republic (Parliament) elects the ombudsman from nominees proposed by at least 15 members of the Parliament.

Term of the ombudsman's office is five years, starting from the date of taking a vow. The same person may be elected for the ombudsman in two subsequent terms of office at most.

Under this Act, everyone who thinks that fundamental rights and freedoms have been breached in conflict with the law or principles of a democratic and legal state at proceedings, decision-making or inactivity of a public administration authority may appeal to the ombudsman.

This Act is in force from 1 January 2002.
