Amendment to the Act on TrademarksAct No. 577/2001 Coll., amending and supplementing Act No. 55/1997 Coll. on Trademarks The amendment to the Act on Trademarks defines widerly trademarks as any designation that may be graphically expressed and which include in particular words, including personal names, letters, numbers, pictures, pattern of the product or its packing, or their mutual combinations able to distinguish goods or services from different entrepreneurs, registered in the trademark registry. The amendment further defines the terms such as identical or interchangeable designations or trademarks. The amendment also regulates and improves provisions related to submission of trademark application, right of priority, division of trademark application and transfer of rights from the trademarks application, as well as possibility to file objections towards the registration of the designation in the registry, the possibility of adjustments of trademarks and of the list of goods and services, for which the trademark is registered. In addition to the above, the amendment specifies provisions concerning deletion of trademark from the registry of trademark, as well as provisions related to the proceeding in respect of trademarks. This Act is in force from 1 January 2002. |
