Suspension of Proceedings

Judgement of the Supreme Court of the Slovak Republic dated 26 February 2002, file No. 5 Cdo 149/01, published in the Collection of Opinions of the Supreme Court and Decisions of the Courts of the Slovak Republic No. 6/2003

A lack of substantial requisites of a petition cannot be a reason for rejection thereof. It is not possible to derive, from the deficiencies of the petition being its inaccuracy or incompleteness, the non-existence of urgent legal interest pursuant to the provision of Section 80 lett. c) of the Civil Procedure Code; only suspension of the proceedings may be a procedural consequence.
