Slovak Financial Law News 2004Business Companies, Winding-Up of the Company by a Exchange DecisionResolution of the Supreme Court of the Slovak Republic dated 30 July 2002, file No. 3 Obo 280/2000, published in the Collection of Opinions of the Supreme Court and Decisions of the Courts of the Slovak Republic No. 5/2003 The conditions for winding-up of a company pursuant to Section 68 para. 6 of the Commercial Code must be fulfilled at the time of decision-making by a court. It depends on the review of specific circumstances of the case whether the court selects the procedure according to Section 68 para. 7 of the Commercial Code before taking a decision on the winding-up of the company. The determination of a period for remedy of the deficiency, for which the company is to be wound up, shall be appropriate, if it is possible to assume with respect to the circumstances of the case that the deficiency shall or may be remedied. © Cechová & Partners (Bratislava) |
