Slovak Financial Law News 2005

Compensation

Ruling of the Supreme Court of the Slovak Republic dated 29 May 2003, file No. 5 Cdo 39/03, published in the Collection of Opinions of the Supreme Court and Decisions of the Courts of the Slovak Republic No. 4/2004

A possibility to agree on compensation and the right to use the released flat pertaining thereto is allowed by contractual autonomy of the entities in civil law relationships.

An agreement on the compensation agreed upon in the contract on the lease of a flat is not an invalid legal act only due to the fact that such agreement is not governed by the Civil Code or any other legal regulation.

This agreement is binding upon the parties to the contractual relationship.
