Slovak Financial Law News 2005Parental Rights and Duties, Education of a ChildParental rights are borne by both parents and also a minor parent above 16, if determined by court in a special statement within the ruling on personal care for a minor. Parents are granted the right to educate children according to their own religious and philosophical beliefs and also the right to use suitable educational procedures, unless the child's health, dignity, metal, physical and emotional development are endangered. If either of the parents fails to perform its parental rights and duties in a due manner and if for the benefit of the minor, the court may, depending on the significance of the case (a) suspend the exercise of parental rights and duties, (b) restrict the performance of parental rights or (c) withdraw the exercise of parental rights from a parent. If the exercise of parental rights is withdrawn from both parents or the only parent alive, the court will nominate a guardian for the minor and in the case of restriction of the exercise of parental rights, the court will appoint a custodian. © Chechova & Partners (Bratislava) |
