Amendment to Act on Prices

Act No. 68/2005 Coll. amending and supplementing Act of National Council of the Slovak Republic No. 18/1996 Coll. on Prices, as amended and on Amendment and Supplement to Certain Acts

This Amendment to Act on Prices changed the scope of authorities, which perform competences in price area and price politic. According to the Amendment, price authorities, which perform competences in price area are (i) the Ministry of Finance of the Slovak Republic (the ``Ministry''), (ii) the Ministry of Health of the Slovak Republic, (iii) other authorities of state administration, pursuant to special regulation, (iv) higher territorial units, (v) municipalities, (vi) financial control administrations, and (vii) the Slovak Trade Inspection.

The Ministry of Construction and Regional Development of the Slovak Republic, which performed competences in area of regulation and control of prices for apartment renting has been excluded from the scope of authorities competent in price area. After this Amendment came into effect, the competences in this area shall be perform by the Ministry, while proceeding in first instance shall be held by financial control administrations and proceeding in second instance shall be held by Ministry.

After this Amendment came into effect, the Ministry of Health of the Slovak Republic shall perform competences besides area of product and output prices in health care and area of renting of non-residential premises in health centres, also in area of services in the health care.

Pursuant to the Amendment, municipalities shall stipulate the maximum prices of municipal regular passenger traffic, perform price control and administration proceeding in matter of breach of a price discipline as regards their own decisions on price regulation.

Administration proceedings commenced before effect of this Amendment, shall be finished by former competent price control authorities within the range of their competences pursuant to the previous legal regulation.

This Amendment repeals Ordinance of the Ministry of Construction and Regional Development of the Slovak Republic of 22 December 2003 No. V-1/2003 on Price Regulation for Apartment Renting.

This Amendment also amends and supplements certain acts, namely Act on Income Tax, Act on Tax and Fee Administration, Act on Protection of Economic Competition, Act on Tax Advisors and Slovak Chamber of Tax Advisors, Act on State Treasury and Act on Alcohol Excise Tax.

This Act came into effect on 1 March 2005, except for certain provisions, which came into effect on 1 July 2007.
