AMENDMENT TO IMPLEMENTARY DECREE TO THE ACT ON ROAD TRANSPORT(Decree of the Ministry of Transport, Posts and Telecommunications of the Slovak Republic No. 109/2003 Coll., amending and supplementing the Decree of the Ministry of Transport, Posts and Telecommunications of the Slovak Republic No. 311/1996 Coll., implementing the Act of the National Council of the Slovak Republic No. 168/1996 Coll. on Road Transport) This decree amends and supplements the Decree of the Ministry of Transport, Posts and Telecommunications (the ``Ministry of Transport'') No. 311/1996 Coll., implementing the Act No. 168/1996 Coll. on Road Transport, as amended (the ``Road Transport Act''). This decree regulates the method of performance and the content of examination for obtaining of a professional qualification for the performance of business activities in the road transport. An applicant for the performance of business activities in the road transport shall be obliged, inter alia, to prove also his/her financial reliability. This reliability shall be proved, as of the effectiveness of this decree, by a balance sheet based on accounting procedures for entrepreneurs using the double-entry bookkeeping system, or as the case may be, by a statement of assets and liabilities based on accounting procedures used in the single-entry bookkeeping system. Previously, the financial reliability was proved by a certificate of the district office. The decree introduces a new regulation of the performance of business activities in case of transportation of dangerous objects. Drivers as well as so-called ``security advisors'' in the freight road transport in case of transportation of dangerous objects must take a special professional training and obtain a certificate of professional qualification. The decree further regulates requirements and methods of control of transportation of dangerous objects. Transportation permits for the performance of international transportation are distributed to carriers by the Ministry of Transport each year, in conjunction with the number and types of permits acquired by the Ministry of Transport under international treaties. The decree stipulates details and a manner in which such permits are granted to the carriers by the Ministry of Transport. District offices have been excluded from the list of authorities performing state supervision in the road transport. The decree further supplements and amends some annexes to the decree, particularly in connection with introduction of professional training of drivers and security advisors for the transportation of dangerous objects, as well as in connection with the change of content of an examination for obtaining of a licence to perform business activities in transport.
