(Ruling of the Supreme Court of the Slovak Republic dated 30 April 2002, file No. Obdo V 27/2001, published in the Collection of Opinions of the Supreme Court and Decisions of Courts of the Slovak Republic No. 6/2002)

A procurist is entitled to represent an entrepreneur in civil court proceedings. He does not need a special power of attorney for this purpose to be granted by the entrepreneur, and so it is not necessary to deliver any document to him pursuant to Section 49 of the Civil Procedure Code (i.e. as to an authorised representative empowered by a special power of attorney).

Pursuant to Section 14 of the Commercial Code, an entrepreneur, by granting a procuracy, authorises a procurist to take all legal acts which occur in the ordinary course of business, for which in other cases a special power of attorney shall be required. The authorisation to represent the entrepreneur in civil court proceedings, for which representation a special power of attorney shall be otherwise required, also results undoubtedly from the quoted provision.
