DECREE ON QUALIFICATION FOR OPERATION OF PUBLIC WATER SUPPLIES AND PUBLIC SEWERAGE

(Decree of the Ministry of Agriculture of the Slovak Republic No. 124/2003 Coll., stipulating Details of the Qualification for Operation of Public Water Supplies and Public Sewerage)

The Decree stipulates in particular requirements for qualification, the scope of a professional competence examination, establishment and activities of professional commissions examining the applicants and details of the certificates of professional competence for the operation of public water supplies and public sewerage.

According to the Act No. 442/2002 Coll. on Public Water Supplies and Public Sewerage, a legal person may operate public water supplies or public sewerage only through a professionally qualified natural person, so called professional representative. Professional qualification is, according to this law, evidenced by a certificate of professional competence for the operation of public water supplies and public sewerage for categories of water supplies or sewerage marked from I. to III. (the ``Certificate''). The Certificates will be issued by the Ministry of Agriculture or other authority empowered by the Ministry based on the passed examination of the applicant. The Ministry keeps a register of granted Certificates.

The examination has a written and oral part and verifies theoretical knowledge relating to (i) technical and technological process regarding water supply and sewerage, (ii) generally binding legislation regulating water economy, environment focused on protection of water, land planning and construction regulation, and (iii) generally binding legislation regulating safety and protection of health at work in respect of working activities performed by the operation of water supply or sewerage. If the applicant failed the examination, it may not be repeated sooner than 6 months after the day of the last examination.

This Decree came into effect on 15 April 2003.
