EXECUTION OF THE ACT ON PACKAGINGS

(Decree of the Ministry of Environment of the Slovak Republic No. 5/2003 Coll., executing the Act No. 529/2002 Coll. on Packaging and amending and supplementing certain other acts)

This Decree (the ``Decree'') executes the Act No. 529/2002 Coll. on Packaging and amending and supplementing certain other acts (the ``Act''). The Decree regulates details of requirements of composition and characteristic of packaging, details of labelling the packaging, details of registration of packaging and its keeping. Moreover, the Decree regulates the content and method of administration of the Registry of liable persons (the ``Registry'') and contains a specimen of certificate of registration. Under the Act, the obliged person is an entrepreneur who introduces packaging or products in packaging to the market (the ``Liable Person'').

Pursuant to the Act, the Liable Person, who is obliged to arrange the collection of waste from packaging and improvement or recycling under the Act, is at the same time obliged to ask for registration in the Registry at the Ministry of Environment of the Slovak Republic (the ``Ministry'') within 2 months from occurrence of the above mentioned duty.

According to Section 4 of the Decree, the Liable Person also maintains the records of packaging based on type of materials, quantities of re-applicable packaging and quantities of improved waste of packaging and recycled waste of packaging according to specimen stated in the annex to the Decree. The Liable Person keeps the records continuously in electronic or written form. The Liable Person also announces the following information from the Register to the Ministry: data on the volume of production, import and export of packaging, as well as information on volume of re-applicable packaging and improved waste of packaging and recycled waste of packaging.

Under Section 6 of the Act, the Liable Person shall arrange for the labelling of the packaging, containing the following information on:

  1. materials which the packaging is made of,
  2. the fact whether the packaging is re-applicable, or deposited and not re-applicable,
  3. method of disposal of the packaging.
The details of requirements for the composition and characteristic of packaging are stipulated in the annex to the Decree. The requirements for production and composition of packaging include e.g. requirements under which the packaging is produced so that its volume and weight is reduced to the minimum quantity appropriate for keeping the necessary level of safety, hygiene and suitability for the product in the packaging and for the consumer, in order to ensure its repeated use, improvement, including recycling, and to minimise the impact on environment by the process of destruction of the packaging.

In addition, the Decree particularly stipulates requirements for characteristic allowing repeated use of packaging, requirements for characteristic susceptible of re-collection of packaging and requirements for characteristic allowing improvement of packaging.

With regard to the provision on labelling of packaging, it shall enter into effect from 1 January 2006.

The Decree came into force on 10 January 2003, save for Section 3, which will become effective on 1 January 2006.
