UNJUSTIFIED ENRICHMENT

(Ruling of the Supreme Court of the Slovak Republic dated 24 April 2001, file No. 1 Cdo 73/2000, published in the Collection of Opinions of the Supreme Court and Decisions of Courts of the Slovak Republic No. 3/2002)

Pursuant to the provisions of Section 524 et seq. of the Civil Code, receivables arising from unjustified enrichment may be also assigned.

From a notice, or evidencing to the debtor that his creditor has assigned a receivable, the debtor may dispose of the obligation to its fulfilment, only if he fulfilled his obligations towards the assignee, save for cases stated in Section 530 para. 1, the second sentence of the Civil Code, i.e. if the assignee gives its consent with the assertion of the receivable to the assignor in case the assignor asserts the receivable himself.
