The agreement on transfer of membership rights in the building association cannot be deemed as an agreement on substitute housing pursuant to Section 712c(3) of the Civil Code. Therefore, conclusion of such agreement will not cause termination of a claim for the substitute housing pursuant to this provision.
For purposes of a decision on execution of a judgement, a court may not solve an issue of termination of the right to the substitute housing in the execution proceeding as a preliminary issue.
