INFORMATION ON NOTARIAL CENTRAL REGISTRIESSince 1 January 2003, notarial central registries, being public lists held by the Notaries' Chamber of the Slovak Republic (the ``Chamber'') in electronic form and containing data stipulated by the law, are accessible at the web site of the Chamber http://www.notar.sk. The said web site enables an access to information in (1) the Notarial Central Registry of Pledges to Movable Assets, (2) the Notarial Central Registry of Voluntary Auction Sales, (3) the Notarial Central Registry of Notarial Deeds and (4) the Notarial Central Registry of Verified Signatures. The Notarial Central Registry of Designated Legal Persons (i.e. legal persons under Section 48 (3) of the Act No. 366/1999 Coll. on Income Taxes to which a tax payer may remit 1% of the paid income tax) has been accessible on the internet since the autumn of 2002. The Notarial Central Registry of Testaments, which is not a public register, is not and will not be accessible on the internet. Searching in the Notarial Central Registry of Pledges to Movable Assets is possible according to the number and the year of registration, identification of the pledger, identification of the creditor and according to identification of the pledged assets. Searching in the Notarial Central Registry of Voluntary Auction Sale is possible according to the number and the year of registration, identification of the debtor, identification of the assets and the place of the auction sale. The above mentioned web site further enables a verification of the existence of a Notarial Deed by using the Notarial Central Registry of Notarial Deeds and the identification of the Notary' office in which the Notarial Deed was executed. The information may be obtained on the basis of submission of the number of the notarial deed. Moreover, a confirmation of information regarding verification of a signature on a deed by a Notary Public is possible in the Notarial Central Registry of Verified Signatures. At present, before verification of a signature, a Notary Public asks electronicaly for allocation of a number in the Notarial Central Registry of Verified Signatures. Such number is valid for the whole territory of the Slovak Republic. Hence, each verified signature within Slovakia has allocated only one particular number. Based on the said number together with submission of further identification data of the signing person, it is possible to verify the signature in the above mentioned register on the internet. Searching in the Notarial Central Registry of Designated Legal Persons is possible based on basic identification data of legal persons (business name, identification number (IÈO), etc). At the same time, it is possible to create summaries according to the legal form, bank and registered seat of designated legal persons. An introduction of new fees and increase of the current fees is connected with the above mentioned changes, considering also increase of administration costs relating to registration in electronic form. © Cechová & Partners (Bratislava) |
