If a party specified in the petition has no legal personality, i.e. is incapable of being a party to legal proceedings, the court may not accept that an entity with legal personality replaces such incapable entity in commenced proceedings; a lack of capacity to be a party to the proceedings is an inherent lack of pre-condition for this proceedings, due to which the proceedings shall be terminated.
