INTEGRATED PERMISSION AND CONTROL IN THE AREA OF ENVIRONMENT

(Act No. 245/2003 Coll. on Integrated Prevention and Control of Pollution of Environment and on amendment and supplement of certain other acts)

The new Act on Integrated Prevention and Control of Pollution of Environment introduces a common permission of industrial activity facilities that may substantially contribute to pollution of environment.

The new act regulates:

  1. integrated prevention and control of pollution of environment,
  2. rights and duties of operators of industrial activity facilities,
  3. tasks of public administration bodies in the integrated prevention and control of pollution,
  4. information system of the integrated prevention and control of pollution, including inter alia a register of permissions and register of operators of sources of pollution, and
  5. conditions of qualification for provision of professional advisory in the area of integrated prevention and control of pollution.
An integrated permission replaces individual decisions, opinions, statements or approvals issued up to present pursuant to other legal regulations. The requirements for industrial activities in affected facilities are determined in the integrated permission on the basis of application of the best available technology in the location of their placement, whereas there is a principle in practice that emission limits and other requirements for the activity of a facility determined in such permission may not be less moderate than the ones that would be stipulated under individual acts and other special legal regulations.

The integrated permission includes decisions in the areas of protection of air, water, waste, agricultural and forest lands, protection of human health, veterinary protection of territory, protection of nature and landscape, or building proceedings. The bodies authorised to grant permissions pursuant to partial regulations are only affected bodies in the integrated proceedings.

The Slovak Inspection of Environment is an administrative body performing integrated prevention and control. This institution shall be, in addition to issue of administrative decisions, obliged to provide consultations and preliminary discussions on the applications prior to their filing, upon requests of the operators. It shall issue written opinions on the basis of these applications.

This act became effective on 31 July 2003.
