AMENDMENT TO ACT ON COURT COUNCIL

(Act No. 267/2003 Coll., amending and supplementing the Act No. 185/2002 Coll. on Court Council of the Slovak Republic and amending and supplementing certain other acts)

The amendment to the Act on Court Council of the Slovak Republic responds to some practical deficiencies which occurred in the previous regulation of its activity, in particular the award of the Constitutional Court of the Slovak Republic No. 5/03 on breach of rights to the access to be elected and access to other functions at the election of a chairman of the Supreme Court of the Slovak Republic by the Court Council of the Slovak Republic.

The process of election of a chairman and vice-chairman of the Supreme Court as well as their recalling are newly regulated. The amendment also regulates a co-operation between the Court Council of the Slovak Republic and other public authorities and it entrusts the judges' councils established at general courts with duties in relation to the Court Council of the Slovak Republic.

The amendment also introduces new provisions on arrangement of the activity of the Court Council of the Slovak Republic by its office and contains also minor amendments to the Act No. 312/2001 Coll. on Civil Service and the Act No. 303/1995 Coll. on Budgetary Rules.

This act became effective on 26 July 2003, provisions on the Office of the Court Council shall become effective on 1 January 2004.
