Act on Judical Council of the Slovak Republic

Act No. 185/2002 Coll. on Judicial Council of the Slovak Republic and amending and supplementing certain other acts

This act stipulates details of composition, organisation and activity of the Judicial Council of the Slovak Republic. At the same time, it contains amendments to the following related acts: the Act No. 385/2000 Coll. on Judges and Associate Judges and the Act No. 335/1991 Coll. on Courts and Judges.

The Judicial Council is an administrative authority in the area of jurisdiction with a strong self-administration element. The Constitution entrusts the Judicial Council mainly with the powers of nominating judges, representing in international judicial bodies, the disciplinary power towards judges and budgets of courts. In addition to the competency stipulated by the Constitution of the Slovak Republic, the powers of the Judicial Council of the Slovak Republic are extended mainly by competency of organisational nature. The Act contains detailed provisions on the election and appointment of the members of the Judicial Council.

The amendment to the Act on Judges and Associate Judges contains new provisions on assignment, displacement and secondments of judges, inconsistency of performance of the judge's office and immunity of judges.

The amendment to the Act on Courts and Judges contains new provisions on activity and distribution of work in courts.

This Act came into force on 16 April 2002.
