Order on Prerequisites of an Application for Provision of Investment Incentives

Order of the Ministry of Economy of the Slovak Republic No. 235/2002 Coll. stipulating the Details of Prerequisites of an Application for Provision of Investment Incentives

One of the legislative measures for support of investments into the economy of the Slovak Republic is the Act No. 565/2001 Coll. on Investment Incentives and amending and supplementing certain other acts (the ``Act'') stipulating the requirements of provision of individual state support for development of regions in the form of investment incentives, procedure and operation of state administrative bodies and the National Labour Office in its provision and control of use.

The essential prerequisites of an application for provision of investment incentives are stipulated in Section 3(2) of the Act. The Ministry of Economy of the Slovak Republic in accordance with the authoritative provision of Section 3(3) of the Act stipulates details of prerequisites of such application for provision of investment incentives by this order (the ``Order'').

An application shall contain the following expressly stipulated prerequisites:

  1. business name of an applicant, its seat, identification number and tax identification number if assigned,
  2. same information as stated under letter a) above on other legal entity that is to be a recipient of investment incentives (the ``Recipient''), if the applicant itself is not the Recipient,
  3. first names and surnames of members of the statutory body of the applicant,
  4. investment incentive asked by the applicant (pursuant to Section 2(1) of the Act),
  5. value of particular types of investment incentives divided according to Section 2(1) of the Act in accordance with the Act No. 231/1999 Coll. on State Support, as amended,
  6. grounds, mainly information on planned amount of funds for acquisition of tangible and intangible fixed assets, manner of financial security of investments, information on anticipated increase in job positions and anticipated costs,
  7. information on placement of investments (cadastral territory, plot number, acreage, type of land and ownership or other legal relations to lands),
  8. information on existing establishment, buildings for production or services and on production and services performed in these buildings if an investment into the existing establishment is concerned,
  9. information on planned construction of new building objects and operational units or on anticipated new use of the existing buildings and operational units after their reconstruction,
  10. further technical and economical information on planned investment necessary for judgement of the fulfilment of requirements for provision of investment incentives stipulated in Section 2(2) of the Act, accrued for individual years,
  11. identification of information in the application or its annexes subject to protection under separate regulations.
Section 1(2) of the Order specifies annexes to the application, the submission of which is required for consideration and verification of security of a project, consideration of impact of the project on public funds, environment and employment in the region, as well as effectiveness of the project for economy of the Slovak Republic.

Annexes to the application are as follows:

  1. extract of the applicant from the Commercial Registry; if the applicant is a foreign legal entity, an extract from the Commercial Registry or a similar document issued by a relevant body of the state in which the applicant has its seat,
  2. document proving financing of investment,
  3. time plan of the acquisition of tangible and intangible fixed assets and realisation of investment,
  4. extract from the Land Book Registry proving information on placement of investment, existing establishment and building objects,
  5. anticipated costs of investment divided into a building part and a technological part according to building objects and operational units,
  6. overview of types, forms and the amount of state support provided to the applicant for the last three calendar years before filing the application,
  7. binding declaration of the applicant on completeness and correctness of information stated in the application and its annexes.
This Order comes into force on the date of its publication, i.e. on 8 May 2002.
