Amendment to the Act on Collection of Laws

Act No. 275/2002 Coll. amending and supplementing Act No. 1/1993 Coll. on Collection of Laws of the Slovak Republic, as amended

The need for adopting an amendment to the Act on the Collection of Laws of the Slovak Republic resulted from approval of the latest amendment to the Constitution of the Slovak Republic changing conception of the status of international agreements in the legal system of the Slovak Republic.

The amendment to the Act on the Collection of Laws introduced a change related to the publishing of full wording of an international treaty, which shall be mandatorily promulgated only in case of international treaties holding the preference over the act and for which an approval of the National Council of the Slovak Republic is required prior to its ratification. In case of other international treaties only notification on conclusion of an international treaty shall be published. However, the Act allows the Ministry of Foreign Affairs of the Slovak Republic to promulgate also the full wording of international treaties in such cases.

The Act on Collection of Laws by its amendment has been supplemented by a regulation when an international treaty comes into force. Pursuant to these provisions, an international treaty comes into force in the manner and on the date determined in its provisions or in other manner according to the rules of international law. The international treaty is promulgated in the Collection of Laws without delay after its delivery for publishing, however at the latest on the date when it comes into force for the Slovak Republic. The international treaty is binding for individuals and legal entities by such promulgation, unless a later date is stipulated in the international treaty.

Furthermore, the amendment specifies in which language the full wording of the international treaty is published. It also gives the possibility of publishing decisions of international bodies and international organisations.

The amendment further regulates the issue of time periods for submitting governmental regulations, decrees, orders, notices and international treaties to be published in the Collection of Laws of the Slovak Republic so that these regulations are published in the Collection of Laws of the Slovak Republic in time before they become effective.

This Act came into force on 1 July 2002.
