New Act on Parental Allowance

Act No. 280/2002 Coll. on Parental Allowance

This Act regulates provision of parental allowance that is a state social benefit, by which the state contributes to a parent for provision of personal and due care of his/her child up to three years of age or of his/her child with long-term unfavourable health conditions up to six years of age. Under the Act, an entitled person to claim for a parental allowance is (a) the child's parent, or (b) the person taking care of a child instead of his/her legal parents upon a special decision.

The requirements of a claim for a parental allowance according to the Act are (a) personal and due care by the parent of at least one child up to three years of age or of a child with long-term unfavourable health conditions up to six years of age, (b) permanent residence or temporary residence of the entitled person in the territory of the Slovak Republic, (c) permanent residence or temporary residence of a child stated under letter (a) in the territory of the Slovak Republic.

The amount of the parental allowance for a calendar month is SKK 3,790.

If the parent is employed or draws sickness benefits in the same period when he/she takes care of his/her child, the parental allowance for a calendar month is SKK 1,200.

As of 1 September of the calendar year, the stated amounts will be adjusted by a measure to be issued by the Ministry of Employment, Social Affairs and Family of the Slovak Republic in such manner that the amounts will be multiplied by a ratio by which the amounts of life minimum have been adjusted. The first such adjustment of parental allowances shall be performed as of 1 September 2003.

This act repeals the previously valid Act No. 382/1990 Coll. on Parental Allowance, as amended, certain provisions of Act No. 274/1994 Coll. on the Social Insurance Company, as amended, and Act No. 543/1990 Coll. on State Administration of Social Security, as amended.

This Act came into force on 1 November 2002.
