New Act on Child Benefit

Act No. 281/2002 Coll. on Child Benefit and Child Benefit Contribution

This Act regulates provision of child benefit and provision of child benefit contribution.

The child benefit and child benefit contribution are state social benefits by which the state contributes to upbringing and nourishment of a dependent child.

An entitled person to claim for child benefit is (a) the dependent child's parent, or (b) the person taking care a dependent child instead of his/her parents on the basis of legal decision of the competent body, (c) major dependent child if there is no person stated under letter (a) or if this child has adjusted obligation to be maintained by his/her parents, (d) major dependent child who got married or whose marriage ceased to exist.

If there are more entitled persons meeting the requirements of a claim for child benefit pursuant to this Act, the child benefit belongs only to one of them.

The requirements of a claim for child benefit are (a) care of a dependent child by the entitled person if it is the entitled person, (b) permanent residence or temporary residence of the entitled person in the territory of the Slovak Republic, and (c) permanent residence or temporary residence of a dependent child in the territory of the Slovak Republic.

The claim for the child benefit does not cease to exist if the dependent child is provided with care in special institution, and the reason for such care is the performance of institutional upbringing on the basis of legal decision of the court or the performance of protective upbringing on the basis of legal decision of the court. The amount of child benefit is (a) SKK 480 per month in case of a child up to 6 years of age, (b) SKK 590 per month in case of a child from 6 to 15 years of age, or (c) SKK 620 per month in case of a child over 15 years of age.

If the dependent child continuously prepares for an occupation by attending a secondary school, the amount according to letter (c) above is increased by SKK 200 or SKK 400 per month in the school year from September to June as far as the entitled person fulfils the requirements stipulated by this Act.

The amount of the child benefit contribution is (a) SKK 200 per month in case of a child up to 6 years of age, (b) SKK 240 per month in case of a child from 6 to 15 years of age, or (c) SKK 270 per month in case of a child over 15 years of age.

The amounts of benefits and contributions will be adjusted by a measure to be issued by the Ministry of Employment, Social Affairs and Family of the Slovak Republic as of 1 September of the calendar year in such manner that these amounts will be multiplied by a ratio by which the amounts of life minimum have been adjusted under a special regulation. The first adjustment of these amounts shall be performed as of 1 September 2003.

This Act repeals Act No. 193/1994 Coll. on Child Benefits and Child Benefit Contribution, as amended, and certain provisions of Act No. 274/1994 Coll. on the Social Insurance Company, as amended, and Act No. 543/1990 Coll. on State Administration of Social Security, as amended, as well as Order of the Ministry of Employment, Social Affairs and Family of the Slovak Republic No. 222/1994 Coll. on Manner of Detecting Income for Claiming Child Benefits.

This Act came into force on 1 July 2002, save for certain provisions which will become effective as of 1 July 2003.
