Act on Social Insurance

Act No. 413/2002 Coll. on Social Insurance

The Act on Social Insurance, after many years of development, unifies the Slovak legislation in the area of social insurance. The act replaces the Act No. 54/1956 Coll. on Sickness Insurance, the Act No. 100/1988 Coll. on Social Security, the Act No. 543/1990 Coll. on State Administration of Social Security, the Act No. 274/1994 Coll. on Social Insurance Company, certain provisions of the Labour Code and certain other acts in the area of social care.

The act defines social insurance, regulates the extent of basic social insurance, legal relations connected with performance of basic social insurance, its administration, financing, state supervision and proceedings in matters of basic social insurance.

The basic social insurance consists of:

  1. sickness insurance,
  2. pension insurance, and
  3. accident insurance.
The basic social insurance means insurance covering loss or decrease of income due to incapacity to work, pregnancy and maternity, age, disability, partial disability, death or injury caused by occupational accident and occupational disease.

The new act also regulates unemployment insurance in the extent of insurance payments and payments to the guarantee fund.

A supplementary pension insurance as well as the proposed capitalisation pillar of pension insurance are or will be contained in separate regulations.

This Act will be effective from 1 July 2003.
